Request a Section 63 assessmentWho needs a Section 63 assessment?
Section 63 of the Climate Change (Scotland) Act applies to certain larger non-domestic buildings in Scotland, generally buildings over 1,000 square metres, when they are being sold or leased. It is linked to improving the energy performance and emissions performance of existing commercial buildings.
This service is commonly required by commercial landlords, selling agents, solicitors, asset managers, property investors and facilities teams dealing with offices, retail premises, industrial buildings, leisure properties and other non-domestic assets.
What is included?
We review the building, available property information and energy performance details to confirm the likely Section 63 position. Where the regulations apply, the assessment can identify improvement measures and support the preparation of the required compliance documentation.
- Review of whether Section 63 is likely to apply
- Assessment of building size, use and non-domestic status
- Review of EPC and energy performance information
- Identification of potential improvement measures
- Support with Action Plan requirements where applicable
- Clear reporting for owners, agents, solicitors and project teams
When is Section 63 usually needed?
Section 63 should be considered early when a larger commercial property is being prepared for sale or lease. Leaving it until late in the transaction can create delays, especially if building information, floor areas or EPC details need to be checked.
If you are marketing, refinancing, disposing of or leasing a non-domestic building, it is worth confirming the Section 63 position before the transaction reaches a critical deadline.
Action Plans and Display Energy Certificates
Where Section 63 applies, the owner may need an Action Plan setting out energy improvement measures. In some cases, operational energy reporting through a Display Energy Certificate route may also be relevant. The correct route depends on the building and the client’s compliance position.
Information we usually need
- Property address and building use
- Approximate gross internal floor area
- Current EPC information, if available
- Floor plans or building layout drawings
- Details of heating, ventilation, lighting and building services
- Sale, lease or transaction timescale
FAQs
Does Section 63 apply to every commercial building?
No. Section 63 is targeted at certain larger non-domestic buildings in Scotland. Smaller buildings, exempt buildings or properties outside the relevant transaction triggers may not require a Section 63 assessment.
Is Section 63 the same as a commercial EPC?
No. A commercial EPC assesses the energy performance rating of the building. Section 63 is a separate Scottish requirement that may apply to larger non-domestic buildings and can require an Action Plan or related compliance route.
How quickly can this be arranged?
Timescales depend on the building size, available information, EPC status and transaction deadline. If the assessment is needed for a sale or lease, send the property details as early as possible.
Do you cover all of Scotland?
Yes. We support Section 63 assessment work across Glasgow, Edinburgh, central Scotland and wider Scottish locations, depending on property type, access and project requirements.
